Terms of Service

By downloading, installing, or using the Tokut mobile application ("App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the App. These Terms constitute a legally binding agreement between you and Tokut.
The App does not require user registration or account creation. Your use of the App constitutes acceptance of these Terms at the time of first use. We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.
Tokut is a photo and media management application that provides tools for organizing, processing, and exporting your personal photos and videos. The App includes, but is not limited to, the following features:
- Photo and video collection management with album organization
- Duplicate photo detection and removal
- Batch processing capabilities including rename, compress, and rotate
- Export functionality to create ZIP archives of albums or all media
- Privacy protection features including encryption and hidden albums
- In-app purchases for virtual currency used to unlock certain premium features
All data processed by the App is stored locally on your device. The App does not transmit your media or personal information to external servers for storage, except as necessary for in-app purchase transactions through platform providers.
You must be at least 13 years of age to use the App. If you are under 18, you represent that you have your parent or legal guardian's permission to use the App and to accept these Terms. The App is intended for personal, non-commercial use only.
You agree to use the App only for lawful purposes and in accordance with these Terms. You shall not use the App to infringe upon the intellectual property rights of others, distribute harmful content, or violate any applicable laws or regulations in the United States or your jurisdiction.
The App offers in-app purchases of virtual currency ("Coins") which may be used to access certain features. All purchases are processed through the Apple App Store or Google Play Store, as applicable. By making a purchase, you agree to the respective platform's terms and conditions.
Virtual currency has no cash value and cannot be exchanged for real currency. Unused virtual currency does not expire but is non-transferable. Tokut reserves the right to modify pricing, feature availability, or virtual currency mechanics with reasonable notice.
All content, design, logos, and materials within the App are the property of Tokut or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from the App or its content without express written permission.
You retain ownership of all photos, videos, and other media that you input into the App. By using the App's processing features, you grant Tokut a limited, non-exclusive license to process such content solely for the purpose of providing the requested services on your device.
You agree not to:
- Reverse engineer, decompile, or disassemble the App
- Circumvent any security or access controls
- Use the App for any illegal or unauthorized purpose
- Transmit viruses, malware, or other harmful code
- Interfere with or disrupt the App's functionality
- Scrape, harvest, or collect data from the App through automated means
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, TOKUT DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Tokut does not warrant that the App will be uninterrupted, error-free, or free of harmful components. You assume all risk for loss of data. We recommend maintaining backups of your media independently of the App.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOKUT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.
IN NO EVENT SHALL TOKUT'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO TOKUT IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED UNITED STATES DOLLARS (USD 100), WHICHEVER IS GREATER. Some jurisdictions do not allow limitation of certain damages; in such jurisdictions, our liability will be limited to the maximum extent permitted by law.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or the App shall be subject to the exclusive jurisdiction of the federal and state courts located in Delaware.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision shall not constitute a waiver. These Terms constitute the entire agreement between you and Tokut regarding the App.
